Construction Work Regulated?

Highway Construction: Contractors must be prequalified by the Department of Transportation before bidding on or performing highway construction projects.

Nonresident Contractors: Contracts valued at more than $10,000 that are awarded to nonresident contractors or subcontractors must be registered with the Department of Revenue. This requirement does not apply to out-of-state corporations that are authorized to conduct business within the state.

Requirements?

Highway Contractor Prequalification: Contractors seeking highway prequalification must submit experience information and financial statements. Audited financial statements are required for prequalification limits exceeding $3,000,000.

A bid bond equal to 5% of the total bid amount is required for all highway contracts. Successful bidders must also provide a performance and payment bond for the full contract amount.

Contract Registration: Nonresident contractors required to register contracts must file a bond equal to 8% of the contract value, with a minimum bond amount of $1,000. Projects covered by a valid exemption certificate require a bond equal to 4% of the contract value, subject to the same minimum amount.

Local Licensing Requirements: Many Kansas cities and counties maintain their own contractor licensing and examination requirements. In many jurisdictions, nationally recognized code examinations may be accepted in place of local testing.

Reciprocal Agreements

Highway Prequalification: Prime contractors bidding on Kansas state highway projects or federally funded highway and road projects must obtain prequalification from the Kansas Department of Transportation (KDOT). Prequalification approvals issued by other states are not accepted by KDOT.
