Construction Work Regulated?

Commercial construction over $50,000 requires a commercial license which is called a Certificate of Responsibility. A Certificate of Responsibility is also required for any construction, reconstruction, repair or maintenance of fire protection systems on public projects over $5,000 or private projects over $10,000.

It is unlawful to submit a bid, enter into a contract, or otherwise engage in the business of a contractor without a Certificate of Responsibility.

New residential construction exceeding $50,000 requires a residential building license. Residential remodeling and roofing projects exceeding $10,000 require a residential remodeling or roofing license.

Requirements?

Commercial applicants must pass a law and business management exam and a specific trade examination (if required) with a minimum score of 70%. Applicants must provide previous work experience and 3 reference letters including 1 from a bank or financial institution. A reviewed financial statement stating the assets, liabilities, and net worth of the applicant is required. Applicants for a major classification must show proof of a net worth of $50,000 and applicants for a specialty classification must show proof of a net worth of $20,000. Also required is a certificate of insurance showing current minimum insurance coverage of $300,000 per occurrence and $600,000 aggregate for general liability purposes. Additionally, an applicant must show proof of current workers' compensation coverage (if applicable). If applicant is a corporation, LLC or Limited Partnership, proof of good standing with the Mississippi Secretary of State must be provided. The application fee as well as the annual renewal fee for a commercial certificate of responsibility is $400.Residential applicants must provide a certificate of general liability insurance, but no minimum policy amount is required. An applicant must also show proof of current workers' compensation coverage (if applicable). If applicant is a corporation, LLC or Limited Partnership, proof of good standing with the Mississippi Secretary of State must be provided. The application fee for a residential license is $50 and the renewal fee is $100. Two hours of continuing education is required for renewal of all residential licenses issued after July 1, 2015 .

The Mississippi State Board of Contractors has reciprocal agreements with the following states as listed below. Applicants must have held an unlimited license for 3 consecutive years and be in good standing in order for the trade exam to be waived; however, all applicants must take the Mississippi Law and Business Management
Exam.


Reciprocal Agreements

The Mississippi State Board of Contractors maintains reciprocity agreements with several state licensing boards. To qualify for reciprocity, applicants must hold an active unlimited license in the reciprocal state for the period required by the applicable agreement and must be in good standing. While qualifying applicants may have certain trade examinations waived, all reciprocity applicants are required to pass the Mississippi Law and Business Management Examination.

Reciprocity agreements and applicable conditions include:

Alabama Licensing Board for General Contractors – Trade examinations may be waived except for mechanical and plumbing classifications. Applicants must have passed the Alabama examination.
Alabama Electrical Contractors Board – Applicants must have passed the Alabama examination.
Alabama Board of Heating, Air Conditioning and Refrigeration Contractors – Applicants must have passed the Alabama examination.
Alabama Home Builders Licensure Board – Applicants must have passed the Alabama examination.
Alabama Plumbers and Gas Fitters Examining Board – Commercial Plumbing examination may be waived. Applicants must have passed the Alabama examination.
Arkansas Contractors Licensing Board – Trade examinations may be waived for all classifications except electrical and mechanical work, including plumbing, boilers, process piping, and HVAC. Applicants must have passed the Arkansas examination.
Florida Construction Industry Licensing Board – Reciprocity applies to General Building Construction and Residential Building Construction classifications. Applicants must have passed the Florida examination.
Georgia State Licensing Board for Residential and General Contractors – Applicants must have passed the Georgia examination.
Louisiana State Licensing Board for Contractors – Reciprocity applies to commercial and residential building classifications. HVAC may be waived; however, mechanical and plumbing examinations are not waived. Applicants must have passed the Louisiana examination.
North Carolina State Board of Examiners of Electrical Contractors – Reciprocity applies to Electrical and Alarm Systems classifications. Applicants must have passed the North Carolina examination.
North Carolina State Licensing Board for General Contractors – Reciprocity applies to Building Construction, Residential Building, Concrete, Grading and Excavating, Roofing, Swimming Pools, Water Lines, and Sewer classifications. Applicants must have passed the North Carolina examination.
Ohio Construction Industry Licensing Board – Reciprocity applies to Electrical, HVAC, Plumbing, and Refrigeration classifications. Applicants must have passed the Ohio examination.
South Carolina Contractors' Licensing Board – Building and Electrical examinations may be waived if the applicant passed an examination administered by PSI, Experior, Block, or NAI. Applicants must have passed the South Carolina examination.
South Carolina Residential Builders Commission – Applicants must have passed the South Carolina examination.
Tennessee Board for Licensing Contractors – Applicants must have passed the Tennessee examination.
